Your Help is Needed to Elminate Wetland Violations

In recent months Town officials have seen a dramatic increase in the number of projects within Conservation jurisdiction, particularly near Lake Monomonac.  The majority of these projects are being done by owners who have not filed for permits and most are coming to our attention by way of complaints called in.  Some of the increase is likely attributable to residents being home more during the day and having increased awareness of projects underway.  Violations have included the removal of trees to pushing sand into the lake to increase property size.

Having outlined the process numerous times to numerous owners, a letter was sent to all lake area residents in late June.  The intent is to have a solid foundation so that everyone in that area knows that any work within 100’ of the water requires Conservation Commission permissions.  We received positive feedback on the letter and a handful of residents have expressed concern that the projects (both unpermitted and approved) will have a cumulative detrimental impact on Lake Monomonac.  We hope to discuss this with the Commission in an upcoming meeting in an effort to ensure a consistent approach.

I am issuing Enforcement Orders, which come with the backing of DEP and their assistance in enforcement, with the most egregious violators and we are working to make processes and timelines clearer for residents.  Much of the process and all of the forms are dictated by MADEP, meaning there is no local control.  Our local wetland bylaw does outline authority for the Conservation Commission to issue fines of up to $300 (each day to be considered a separate offense) per violation.  I will be requesting the Conservation Commission to consider levying a fine to property owners who violate the wetland bylaws to show that the Town is serious about protecting our wetlands, which include Lake Monomonac.
